Congress Grants Gun Industry Legal Shield

this gun is now legal

Well the second amendment is now “the strongest it has been in decades” thanks to the recent passage of a bill designed to shield gun manufacturers and dealers from lawsuits. Hailed as the most significant victory for the gun lobby since the 1986 re-writing of gun control laws, the N.R.A. just couldn’t be happier.

Bush himself said the bill would:

further our efforts to stem frivolous lawsuits, which cause a logjam in America’s courts, harm America’s small businesses, and benefit a handful of lawyers at the expense of victims and consumers.

Silly me. Now I thought the victims of gun-related violence would be the ones helped in any legal action against the gun industry. Leave it to good ol’ Bush to convice us otherwise… Now let’s all go out and buy guns at Walmart and shoot each other to celebrate!

What the Fuck. Congress gets back in session and the first things it can think to do are to shield the gun and fast food industries. Between these laws and the recent bankruptcy reform, its becoming ever more clear that we are now living in a post-democratic corporate state.

Corporations keep getting bigger/more powerful and are now using that leverage to enact legislation designed to take away any power consumers might have to act against them. What tools are we going to be left with to stop corporations when they act against us? I guess Lincoln was right.

With corporations becoming like kings, the return of the evolution debate/rise of religious orthodoxy, and the threat of a pandemic it looks like we’re heading back to the dark ages.

I’m not sure if I should start building a catapult or move to Timbuktu(Korea).

worthy of a little action too, i’d say, and on behalf of not only consumers (or in this case maybe gun violence victims more accurately, both individuals and cities) but also humanity and the world in general, the counterculture in particular, service workers, production workers, students, shareholders, pension holders, artists, voters, people with a sense of humor. which is just to say: don’t you fucking dare just move away. and: the catapult is a good start.

The real insanity of this bill is apparent when its juxtaposed with something like the DMCA. When you look at the larger picture, the DMCA is designed to hold the creator liable (for example, the person who writes / distributes the DeCSS code) for tools that may end up harming individuals. The individuals, however, in the DMCA situation are not actual citizens or humans. No, they’re corporations. So we now have a law that holds people responsible for disseminating information, and a law that prevents gun makers from being held responsible for the things that they distribute. The former is chilling innovation and the dissemination of information at the supposed (the case that has been made for the DMCA has been quite poor) risk of loss of corporate profits, and the latter is ensuring corporate profits at the risk of human life. Where are our priorities?
